Wedding Officiant Quebec – Marriage Ceremony in Montreal, Laval, Longueuil; Mtre Leopold Lincà notary is recognized as a civil marriage celebrant by the Director of Civil Status throughout the territory of Quebec.
Celebrating the wedding and the civil marriage ceremony. The law (the Civil Code of Quebec) requires that future spouses choosing a civil marriage or a civil union must publish their intention to unite by displaying it at the ceremony place and at the Palace of Justice which is closest to the place of their civil marriage ceremony.
Wedding Officiant / The celebrant must make sure that the conditions of publication have been met – posting the announcement at least 20 days before the date of the marriage or the civil union ceremony, but not more than 3 months; after that period, the publication document must be remade. A dispensation must be granted by the celebrant when the couple invokes a serious reason (including moral or humanitarian reasons).
The marriage or the civil union celebrant (whether notary, mayors, members of municipal councils or borough councils as well as municipal officials appointed by the Minister of Justice of Québec, clerks or any other person to whom the Minister of Justice grants the authorization to perform a marriage or a civil union ceremony) before the marriage or the civil union must make sure of the following:
- That the future spouses are at least 16 years old (for the marriage) or that the future spouses are at least 18 years old (for the civil union); the validation of the future spouses’ legal age will be made using their birth certificates or the copies of their birth certificates.
- That a written consent has been given by the Court when one of the future spouses is between 16 and 18 years of age (for marriage)
- That if one of the future spouses has been declared unfit by a judgment that pronounces the opening of a protection regime, he/she has obtained the release of that protection regime
- That the future spouses are not already married or united in a civil union
- That the future spouses are not related by family ties that prohibit marriage
Every celebrant must respect his legal obligations during the course of the ceremony:
- Read in French or in English sections 392 to 395 of the Civil Code of Quebec to the future spouses in the presence of two witnesses (otherwise, the wedding celebrant will ask the couple to provide an interpreter at their own expense)
- Receive the free and informed personal consent of each one of the future spouses
- Require the spouses or the witnesses to sign the declaration of marriage or the declaration of civil union and to provide them a copy as proof of marriage or civil union
- Complete and send after the ceremony the Marriage Declaration or the Civil Union Declaration to the Institute of statistics of Quebec and to the Director d’état civil.
An unforgettable ceremony – The civil marriage ceremony
Once all the legal requirements are met, the wedding ceremony can be customized at the request of both parties according to their special needs or to their dreams in order to be an unforgettable ceremony. For example, the ceremony can be held in the open air, on the beach or in a park, in a romantic place or with touristic connotations.
The ceremony can also be adapted and, at the request of the spouses, the celebrant may explain the ceremony of the candles, the ceremony of the sand, the ceremony of the alliances, the one of the tied hands or he may propose to them different themes of marriage ceremony connected to the place of the ceremony, the season, the spouses’ tradition and so on.
